Legal Question/Alzheimers/calling Muffin or any other Canuck Lawyer

My FIL has recently been diagnosed with Alzheimers. He’s asked my wife to take on the Power of Attourney.

So she’s called a lawyer who says if he has Alzheimers he’s not of sound mind so he can’t give it.

Look, he’s not stupid yet. He has a major memory problem at the moment.

What do we do ?

Not even close to being an attorney here, but…

My grandma wanted to make me her POA, so, I took her to an attorney that deals with ‘family law’ (the same attorney that wrote up her will, handled mom’s divorces, mom’s will, etc.), and he took her into his office, and spoke with her privately, and then he drew up the POA stuff, she signed it, I signed it, and all is taken care of.

She also has Alzheimer’s.

The attorney should speak to him privately, to make sure that he’s not doing the POA thing if he really doesn’t want to do it, I’d imagine.

I’ve been going through something similar, albeit I’m in the U.K. You should get a doctor to certify that he is currently of sufficiently sound mind to sign.
