Legal Question - Can I kick them out?

Regret post this here, but thought I could get a quick 85% solution.
Father is 77 years old, drinks way, way too much and lands in the hospital. He has two guys living in his home, for about 4 months who don’t pay rent and are cleaning him out financially. Can I go over to his house, where I don’t live and kick them out?
I realize that I have conservator and power of attorney issues to deal with in the long term. But in the sort term I want to get these jerks out.

I believe you have to get an eviction order from a court.

But, not being the owner, on what basis could she get an eviction order??? I suspect it wouldn’t be that simple.

I know nothing about american law, but assuming that you’re not deemed mentally unable to take care of yourself or of your finances, how could it be acceptable for a relative to decide, against your will, that someone should be evicted from your house?

If it were me personally I’d go over and threaten them with violence but many people seem to think that never solves anything. :wink:

Not sure I understand the OP. Did these guys move in on their own after your father was in the hospital, or did he invite them to live there?

Dad asked them (or they asked him) to move in there with him a few months ago. They are about 40, big drinkers, don’t work a lot kind of guys. I’m sure that there is no payment to dad, and I’m equally sure that there is no written agreement. I didn’t like this from the start, but for the last month, dad’s been writing checks for $400-$500 every few days and the house is getting trashed. Now with him in the hospital, I’d like to clear this up. Thanks for any light you can shed.

Go to a lawyer immediately. Don’t waste even one further second posting to the SDMB. (You say this is going on right now, so this is somewhat of an emergency.) Ask the lawyer what your legal options are. I am not a lawyer, so I can’t be sure, but it looks to me like you’re going to have to have a judge appoint you as your father’s guardian. (You might try first going to the police and asking if they can help, but I suspect that they will tell you that you need a court order.)

You didn’t say what state your father lives in. Elder abuse laws and their enforcement may vary depending on the state involved. For Washington DC, Adult Protective Services might be worth a call.
