Arguably it does matter. I can think of legitimate reasons why a driver might not want his passengers engaging in hot and heavy sexual activity in his car.
All Ahmad has to do is claim it offends his religion, and SCOTUS will back him.

Here’s the part I don’t understand:
If a quick peck offended the driver so much, why did it take him five minutes to say or do something?
