Judge Jonathan Foster described the incident as an “alleged frolic” wherein the four-man crew of the helicopter dropped the craft below its regulation 1,000 foot altitude to get a better look at the sunbather.
Daniel Crowley, a lawyer for the couple, said the downdraft from the low-flying chopper caused massive damage to the glass ceiling of the conservatory.
