I’d 100% believe his lawyers told him this to keep him off the stand.

Well, we’re well into “turbulent priest” territory, here.

It also forbids him from directing anybody else to comment about the jury or others. Leavitt appeared on Real America’s Voice in her role as a Trump spokesperson.

I have no doubt Trump never told her to do this, but I also have no doubt that she knew in her heart he wanted it done.

It will be interesting to see if the judge buys this line of reasoning.

Totally, its a win-win for them it keeps him from testifying and gives him something to rant about that is not breaking the gag order

I think that Trump assumes that his supporters don’t comprehend the difference.

I’d say she needs to be brought in to explain herself.

Even if they let her off, they need to send a strong message to the next Trumper staff that this is also not allowed.

Should they have to admit that Daniels and Trump did indeed have sex, will the defense say Daniels prostituted herself to get on a TV show? Or is Trump’s ego so big he can’t admit a woman would have to have an ulterior motive to fuck him?

  1. Trump needs to have a discussion with the judge, where he is asked “Did you direct a staff member to make a post about the jury? We have already spoken with this staff member, so answer carefully.”

  2. The judge also needs to ask Trump again if he understands the gag order. If Trump answers in the affirmative, ask him why he then mischaracterized the gag order as preventing him from testifying. Make Trump repeat the words out loud for the court to hear: “The gag order does not prevent me from testifying. The gag order does not prevent me from testifying.”

Cohen is going to have quite the day(s) in court with all this in the record.

Davidson described how Cohen was difficult to deal with, frequently acting in a “pants on fire” manner. Davidson testified that he had “lost trust” with Cohen to pay the money he’d agreed to in the Daniels deal — and at one point he said the deal was off after Cohen failed to meet a deadline. He also described Cohen as despondent during a December 2016 phone call after learning that he would not be getting a job in the White House.

“He said something to the effect of, ‘Jesus Christ can you fking believe I’m not going to Washington after everything I’ve done for that fking guy. I can’t believe I’m not going to Washington. I’ve saved that guy’s a** so many times you don’t even know,’” Davidson testified Cohen told him.

True but that was always going to be the case. The prosecutions main job has been to get the questions about his reliability out in the open (no one in the jury is gonna be shocked when the defense brings this stuff up now), and give corroborating testimony from more reliable witnesses, which they’ve done well IMO

In these types of situations, I like to change “he’s so stupid to believe this” to “he thinks (knows) his supporters are stupid enough to believe it”.
I think, in the majority of these types of cases, he’s fully aware that he’s lying, but his base is eating it up.

I think the Judge just has to give trump a weekend in jail for contempt. Maybe he will listen then.

Here’s a great moment the DA will certainly remind the jury at closing. This was done to influence the election; Davidson and Howard knew it.

Nobody had any doubt that Cohen was doing this to influence the election. There was no other reason.

Now, the issue is whether Cohen was coordinating with donald. So far, the focus has been on Cohen’s actions. They’ll still need to connect this to donald, and identify false business records that he caused or created.

Of course we know that’s coming.

Cohen himself will testify to it (are there more tapes than just the one that was released?), but I’m sure there will be other witnesses who confirm that Cohen (who, as a reminder, was reimbursed by submitting fake invoices for nonexistent legal services) did not provide legal representation, yet was still paid $420,000 from donald, a man who never overpaid for anything.

This is marvelous and I gotta say I love your cogent analyses (also that of @rocking_chair and some others). I’m imagining Trump frothing at the mouth, throwing ketchup and demanding that his lawyers get “more aggressive” than ever to turn this train wreck (for him) around.

And I’m also imagining his lawyers getting more and more frustrated with the orange shitheel, and finally, I can also imagine someone with zero ethics – the kind that Trump likes to hang around with and hire as his lawyers – consoling themselves by looking at their burgeoning bank accounts and drinking a lot of really expensive scotch. Losing this case is a plus to them – they can then continue draining the Orange Fuck’s money almost indefinitely with appeals.

Burgeoned bank accounts. Whatever they got paid up front is it, because you know he’s going to stiff them for anything that wasn’t up front.
