Well, yes, and that is exactly what he was found guilty of having done, with regards to Daniels, in 2016. But, just making the offer this time, assuming that Daniels turned it down, wouldn’t be.
Yeah, he was convicted of falsely reporting actual payments he made, IANAL but I think having intent to do that isn’t a crime itself if the payments never happen. Even then you’d need to prove that he intended to not report it correctly. It’s almost like pre-crime from Minority Report.

(and yes, I know that in theory, the constitution says a president can only issue a pardon on a federal case, not a state case. But Trump doesn’t care, 52 Senators don’t care, and the Supreme court doesn’t care. )

Give him 4 years home confinement. He can sit in the White House being President, but can’t leave. Sentence to begin immediately after he is sworn in, and to end on the final day of his term.
It sucks that the prosecutors agree with the defense to delay sentencing until Trump’s term is over. Apparently that’s their motion according to NBC news right now.
