After 2029, and after he racks up a lot more charges in the course of Trump 2.0, and a lot more criminal convictions, all bets are off as to his admissibility anywhere.

His comments come a day after Judge Juan Merchan announced that sentencing for the president-elect’s 34-count felony conviction would begin on Jan. 10 — handing Trump a blow after he demanded his case be dismissed following his election win.

Also, I feel like this isn’t the first time Trump didn’t appear to know what a judge is. I could be wrong, but I don’t think they create cases.

I don’t care what he thinks.

But what he thinks will dictate what his millions of followers will think. “Trump was fully exonerated!” will enter their worldview, and never leave, and it will color their voting behaviour for years to come.

They do (to varying degrees) in some criminal law systems, but not in New York, and probably not anywhere else in the US.

If Trump was sitting in prison until his dying day his followers would still believe he was exonerated based on whatever right wing propaganda they consume.

Trump was elected due in part to the fact that they don’t think his conviction was for anything real.

Is it possible that Trump’s appeal might backfire on him? Some panel of judges could theoretically rule that yes indeed, justice was not served here at all and actually sentence him to jail. That would be hilarious.

Glen Kisrschner has an 18-minute video that describes how Trump could be blocked from taking office, namely Congress invoking Section 3 of the 14th Amendment,
No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability.

The insurrection accusation is covered in his second impeachment on January 21, 2021 and the Colorado judicial due-process where the court found by clear and convincing evidence that President Trump engaged in insurrection as those terms are found in Section Three.

On appeal to SCOTUS, that august body found that states lack power to disqualify candidates for federal office, but did not address whether Trump engaged in insurrection. Disqualification for engaging in insurrection is no different from disqualification based on other constitutional requirements such as age or 14 years residency.

To make such an objection requires a petition signed by 20% of the members of each house. If the objection is sustained by a majority of each house the vote for that candidate is not counted and the number of votes required to be elected is reduced by the number of disqualified votes IOW Harris has the only votes left.

Naturally, for this scenario to happen requires the participation a number of Republicans so the odds are nil but Democrats in both houses just took an oath to defend and protect the Constitution. So did the Republicans but I have no faith they will uphold it.

Sorry, but appeals courts do not sentence people to prison or jail or even a fine. At best, they remand the case to the lower court with instructions to do the sentencing over.

Hmmm, well with that being the case, could they say “we think this should be jail-worthy so please try again lower court judge”? Or do they have to be completely oblique about which direction sentencing should be adjusted in?

Well, my issue with that is that trump has not been convicted of those crimes. And of course- it has zero chance of happening.

Since you did not bother to watch any of the video, I’ll take your opinion with a grain of salt.

Kirschner makes a persuasive case on the insurrection grounds. The problem is that nobody cares. Congress and the Supreme Court were both given the powers they have as a crucial part of the system of checks and balances, but when both institutions are in the tank for Trump, and there aren’t enough Democrats in Congress to matter, then this is no longer a nation of laws. Republicans abandoned any semblance of principles or integrity a long time ago, if they ever had them.

Wrong. He was convicted by both the House and the Senate in the second impeachment. What the Senate failed to do was reach the 2/3 majority required to remove him from office. And in the Colorado case he was subject to the full protection of due process and lost. The Supreme Court didn’t overturn the finding, instead ruling that a state didn’t have the power to remove a candidate from a federal ballot.

He wasn’t convicted by the House, because that’s not what they do. And he wasn’t convicted by the Senate, because they didn’t reach the 2/3 majority.

Yes, I need to revise my statement, but the general thrust of what I got from the Kirschner video was correct. Trump wasn’t “convicted” by the House because the correct word for what they did is “impeached”. The point is they sent it to the Senate for trial. You’re correct that the Senate failed to convict him, but a majority – 57 Senators – voted “guilty”, which is a pretty damning outcome after due process with a bunch of lawyers defending him – hardly the exoneration Trump claimed it was.

I just heard on NBC that Merchan just denied Trump’s motion to delay Friday’s sentencing. I’m with a trash crew so can’t cite at the moment.

I’m still hoping that Merchan hits him with a list of punishments, narrowly targeted to Trump’s deceits and dishonesty towards his own followers.

  • Requirement to release his tax returns for the past X and following Y years
  • Community service time for time spent golfing previously or in the future, while acting as president - time to be served after he leaves office
  • Requirement to truly divest from his businesses while serving the country
