Every time a gag order has been placed on him it has resulted in an appeal and a delay while that appeal is heard, then further appeals when the first appeal is lost, rinse, repeat. Delay, delay, delay. (Incidentally, every time he whines about “now they’re putting me on trial, right during the election, why not earlier??!!!” I want to yell at the TV “because you’ve purposely caused endless delays, you bloated oxygen thief!”)
If we weren’t talking about real danger to real people I’d say let him run his filthy foul mouth and just get on with the trial.
Courts have all been treating him with kid gloves, but I believe this is the first case has in the New York State criminal justice system (as opposed to the feds).
Orders regarding pretrial publicity would not be uncommon in a high profile case (perhaps even indicating to what extent media is given access to the proceedings). A gag order regarding jurors, litigants, and court personnel would be completely in line with that.
Those aren’t usually appealable orders. I mean, he could object, and if he loses at trial can appeal the trial judge’s decision, but in a typical criminal trial the defendant doesn’t get to stop the case and raise an appeal every time the judge enters an order.
You’re absolutely right. I looked it up after reading your post, and apparently I was conflating all of the other appeals that resulted in trial delays with the gag order appeals. It’s so hard to keep track sometimes! Thanks for the correction.
It can sometimes be hard to follow one trial because most of us aren’t familiar with the ins and outs of court procedures and the legal system as a whole. It gets really confusing when it comes to Trump becaues we’re looking at multiple criminal and civil cases throughout different jurisdictions. I’m not expert of course, so I don’t mind saying I’ve gotten confused a few times just trying to keep it all straight.
For the gag orders, it’s about intimidating potential witnesses and playing to Trump’s base. Every time he talks to the press about his trials he’s stumping for his campaign. I don’t think it’s working for him overall but Trump’s base certainly eats it up.
I trying to imagine how a request to delay the trail until the gag order was appealed would go.

If you’re familiar with my posts, and I’m going to guess that you’re not, you would be aware that I’ve made the exact same point several times in threads around here.
However, you ignored the main point of my post, which isn’t that Trump is entitled to kid gloves because he is running. He isn’t, and that’s painfully obvious. But the unique situation does provide this SCOTUS with opportunities to further erode our First Amendment rights if gag orders are not carefully crafted. That’s the true danger of which I believe the federal appeals courts have been very mindful. So maybe less “cute” than you assert.
So does he go to jail now, or will this just be one more lesson to him that he can ignore all the court orders he wants and never face any consequences for it?

My old boss was married to a very skilled attorney. She left the profession because she had hoped to be a counselor who helped steer her clients away from jeopardy, but that isn’t what the clients wanted or the firm expected.
This is Trump. He uses attorneys to help him define the ragged edge of the line, or a point 15-20% over the line, and then to bail him out when that area ends up being rife with anti-personnel mines.
TL;DR: it appears as though his latest fusillade of stochastic terrorism did NOT violate the recent Gag Order, technically.
I fully believe that TFG’s latest screed was written by an attorney. It almost certainly wasn’t written by him. There were no ALL CAPS comments. No misspelled words. It was almost coherent. Still stupid though.

What you say is possible, but it could also prove to be enraging. Waiting for concrete consequences for Trump due to his big damn dumb mouth is driving me up a wall.
It’s a shame the judge in the Georgia case opened the door to Trump getting officials dismissed on account of the “appearance of impropriety”. Absolutely everyone is guilty of this in one way or another and Trump will exploit this as much as he can to say he can’t possibly be prosecuted by anyone because they are all out to get him. Now that Trump has had some success with this strategy he will repeat it over and over in every single case.
