Yes, under federal law a person cannot legally own a firearm if they use marijuana.

I expect that will change if the federal restrictions on marijuana use are lifted, but for now that’s true.

As it is legal in this state, I don’t think I’m going to worry over much about a federal law that is in the process of going away.

And if I read my research correctly it’s only legal under Michigan law if you have a medical card. And that card is valueless under the BATF.

People do occasionally get popped for lying on the 4473 form.

Besides, why do you think I ever did any paperwork for any of my legally owned guns? BATF has never seen my signature.

While that’s true, as of 2018 not all cannabis products are “marijuana” for the purposes of the Controlled Substances Act and, by extension, the Gun Control Act of 1968. That’s why CBD products have been sold at gas stations for the past four years. Thank Mitch McConnell for Public Law No: 115-334 (2018):

SEC. 12619. CONFORMING CHANGES TO CONTROLLED SUBSTANCES ACT.

    (a) In General.--Section 102(16) of the Controlled Substances Act 
(21 U.S.C. 802(16)) is amended--
            (1) by striking "(16) The" and inserting "(16)(A) Subject 
        to subparagraph (B), the"; and
            (2) by striking "Such term does not include the" and 
        inserting the following:

    "(B) The term 'marihuana' does not include--
            "(i) hemp, as defined in section 297A of the Agricultural 
        Marketing Act of 1946; or
            "(ii) the".

    (b) Tetrahydrocannabinol.--Schedule I, as set forth in section 
202(c) of the Controlled Substances Act (21 U.S.C. 812(c)), is amended 
in subsection (c)(17) by inserting after "Tetrahydrocannabinols" the 
following: ", except for tetrahydrocannabinols in hemp (as defined 
under section 297A of the Agricultural Marketing Act of 1946)".

In all the fuss–admittedly well-deserved–isn’t everybody forgetting something?

Namely this–that ADHD or not, poor impulse control or not, 10 years of age is plenty old enough to start learning and exercising self-control. I’m sure the boy was scared, and I have considerable sympathy for him. But hopefully this will teach him the value of thinking ahead instead of simply doing stuff. He is old enough to start taking a certain measure of responsibility for his actions, in spite of the fact that he has medical issues.

If not, he’s likely to get into far worse trouble down the road.

I love how that law uses the term ‘marihuana’ rather than cannabis. The US has ingrained bigotry in its laws.

From 1910 to 1920, the United States saw tens of thousands of Mexicans immigrating to the southwest in the wake of the Mexican Civil War. The influx of immigration escalated anti-Mexican immigrant sentiment and a campaign of “reefer madness” among white Americans, most commonly by America’s resident xenophobe and the commissioner of the Federal Bureau of Narcotics, Harry Anslinger. Anslinger’s propaganda campaigns created racist narratives, like those who smoke marijuana are of an “inferior race” and are more likely to engage in sexual promiscuity and violence. By adopting the Spanish word “marijuana,” rather than the already widely-used “cannabis,” Anslinger and other prohibition activists of the early to mid-19th century were intentionally connecting the use of marijuana by brown and black bodies, to dangerous and fabricated side effects of the drug.

Problem is that ADHD makes the impulse control much more difficult than for a non-ADHD 10 year old. In some circumstances it might be better to think of the child as an 8 or 6 year old with regard to some executive functioning tasks. Interventions, including medication, can help. It is not a character flaw, but a brain that works differently, and in many cases at odds with societal expectations.

Another way to think of it is telling somebody with two broken legs to just learn how to climb stairs. Given time and physical therapy, they’ll be able to climb the stairs. Making demands that do not take into account the current limitations aren’t helpful to anybody.

I mean, understanding “Mom and dad consume this stuff all the time and its super cool, but if any trace of it ends up at school its a literal crime and you might go to jail if a judge decides to send you” is actually a pretty tall order. What the kid did is on par with taking an empty cigarette packet to school. There was no way to consume it. My 10 year old would not think he was breaking a big rule, I don’t think. When they get a little older there are lectures about alcohol and tobacco and drugs being absolutely illegal on campus, but that’s not really a focus in elementary school. Certainly I wouldn’t expect a ten year old whose parents are really into pot to understand that it’s going to be seen by others as “drugs” and way worse than if he’d beought, like, a contraband figet spinner.

50 years here, too except for a 12 year piss test job. As soon as I was laid up after my accident I started working on getting my body thc back up to its pre job level. In the next few days I’ll try a vape cart for the very first time. Sounds better than smoking, which isn’t ideal, but I have few alternatives.
