Sorry, Caricci, on the reread that sounded like I was taking offense at what you said and I’m certainly not–this is just an upsetting situation. I find the governor’s backpedaling to be ridiculous and I take a great deal of offense at that.

On the radio this morning they were saying that RI’s case was a 1978 law that says that the Narragansetts are subject to State Law. The Narragansetts claim that the law applies to lands, not to people and their actions. If this is true (and if I’m not misquoting), then it seems a little different than Phlosphr said.
That’s true, but from what I’ve found here , it states that “The State and Federal Government consented to the proposal and codified the agreement in the 1978 Rhode Island Indian Claims Settlement Act. At this time, the Tribe consented to live by the laws of the State because they lacked Federal recognition and status.”
Once they were recognized as a sovereign nation in 1983, wouldn’t that override the 1978 ruling? I’ve looked around online but wasn’t able to find anything difinitive.

Specially if said tribe has land on ocean, i.e. no transportation laws to contend with. vote goes against indians. probably got screwed out of “beach front property” anyway…

The original dispute was about limits (the tribes felt that they should not have to pay any attention to limits on how many fish to spear or size limits (not spearing young fish), and they won in court. So they took advantage of that.
Now, in many of the smaller lakes in & around the reservations, there are so few fish left that spearing or any kind of fishing is pretty much pointless.
Call that hitting the jackpot if you want.
