Need to vent, but don't want to cuss in the Pit.

Two days ago the car I was driving was hit by another car that blew through a stop sign without slowing down. I’m not hurt, but the passenger side car door was crunched in, and my car remains driveable.

I stopped, the other driver stopped. I have no cell phone, so I asked if he did so the police could be called. He said “no, no phone” with a Spanish accent. I didn’t want to leave the scene, and was wondering what to do, when a guy who witnessed the collision came over and made a call to the police.

Before they arrived I observed the other driver talking on a cell phone! A woman showed up, apparently the owner of the vehicle that hit me. She asked if the police had been called, I said they had. She didn’t ask “are you ok?” or anything like that. I am fine, though, just shook up.

When the cops began questioning him the driver dude couldn’t speak English, had no form of ID, no driver’s license, and the insurance card was for the vehicle owner. I gave a written statement, the witness did too( and it supported me!). Don’t know what DD wrote as he couldn’t write in English it seems. DD was taken to the jail, in cuffs(Yay!) not because of the accident but because the dumb idiot couldn’t prove that the name he was giving(which I don’t know) was his real name.

Of course the vehicle owner has not reported the accident yet, but I did, to the company she supposedly is insured with. And they’ve called me back and unbent so far as to admit she is a policy holder with them. And how they’ve tried to contact her but have had no response.

My money is on the assumption that DD is illegal as hell. It would have been really cool is they had to keep him overnight or something fun like that. I just can’t stand people who won’t take responsibility for their actions.

Okay, take a deep breath, slow and easy, get your heart rate down. But still, grrrrrrrrr.

That’s seriously maddening, but I’m glad you’re OK.

I am guessing he spoke English better an hour before the crash. It must’ve knocked something loose. If his legal status is in question, it can be a pain in the ass for you, but glad you’re safe. It doesn’t sound like you’d get any blame, wait for insurance.

I hate to say this. But most car insurance policies do not cover the events that involve anything illegal. So if the man was driving without a license and/or an undocumented person and/or drunk, the car owner’s insurance may tell her that she’s SOL (and you by extension).

Have you talked to your insurance company? This could fall back to your ‘uninsured driver’ coverage (then they’ll go after the woman to get the money back). Also, it would be in YOUR insurance company’s interest to contact her insurance company and ‘influence’ them to not deny the woman’s coverage.

The best case would be if you both happen to be insured by the same company. I was rear-ended by a woman who had the same company as me and that was settled really quick.

We don’t have the same insurance company. Mine will have to contact hers.

If you don’t have the coverage for this, you may try small claims.
