I reverse my previous position and Will get into the image business. I will figure out how to do it (maybe get smilies or help from Opalcat) and tell others how to spruce up on their own. Maybe today, maybe next week, but sometime or other. Probably need to start a new thread by then.

A lot of the smiles used in this tread and others that I’ve seen probably stem from here.
Are these ok to use?
The old UBB smilies now point to the new vBulletin smilies. Older threads that were accessing the UBB smilies should now atleast have smilies once again. Due to licensing issues I did not want to reuse the UBB smilies so unfortunately the animation is gone. Please enjoy all the same!

People keep telling me those “flowerkitty” smilies are okay to use, but I’ve looked at the site a couple of times and I’m not convinced.
Just because somebody put smilies on a page and said “go ahead and use them” is probably not enough criteria for us.
Where did they come from orginally? Who holds copyright, if any?
Just because there’s no explanation doesn’t mean go ahead. There’s far too many people that believe everything in cyberspace is their own personal property. “I saw it on a website, it’s okay to take it.” Maybe yes, maybe no.
And what Opal does on her site is her business; in NO WAY is this meant as any criticism, she just makes different choices. Her right. What she extends to her users is up to her. If she’s willing to take the risk, that’s her lookout.
As a corporate entity, we’re held to a higher standard than just plain folks. This site and its contents are copyrighted and we are diligent about protecting ourselves and others. It sure would look bad if we can’t do what we insist others do with our property. (You’re welcome to read here, but you can’t republish our material without permission.)
We remove images pulled illegally from other people’s websites and we try to protect rights whenever possible. There’s enough resources available to every user to use graphics and image files in a safe and legal manner, there’s no excuse for not doing right.

And it turns out I should have posted it here. No matter, I suppose I could repost it here but I seem to remember some regulation about multiposting or crossposting or maybe it was composting, so I’ll just link to it instead.
I’m trying to get a discussion going in this thread about how (as I read it) The Copyright Act of 1976 grants generous (for our purposes) allowances for copyright infringement, and making the general light hearted point that TSDMB is prime example of such a site that can be granted an exception.

Although we’ve had copyright debates in GQ, GD, and the Pit (and other forums for all I know), and at the risk of starting another debate here in ATMB, Irishman and I have posted responses to opus in that thread, concluding that opus’s interpretation of copyright law is a bit too generous.

No, the ‘fair use exceptions’ are rather limited. Using the art on the board is using it without permission. Personal enjoyment and not-for-profit are not fair use exeptions.
