That is true in California. My husband was offered a concealed carry permit when he was a Deputy District Attorney, but he turned it down. Most DAs in his section did the same.

And the issue (as stated in the first linked article) is that nobody with a concealed carry permit can carry while drinking or drugging. Simple. So, DUI for the BAL, and misdemeanor for carrying while under the influence.

Wolfman, the quoted portion of your cite appears to contradict your statement- it seems to me that “possession” in the cite covers the gun being in the passenger compartment with you.

A gun gun in the glove compartment, is not "actual or physical control ". In your hand is “actual or physical” control.

The article seems to indicate that he was released into the custody of his friend the sheriff within at most a few hours of his arrest. If one of us were taken in under similar circumstances in Maryland (not that we would be, considering as we’re such decent law-abiding folks here), would they send us home with a sober friend or would we have to wait a few days to see the judge about it, assuming we are not: 1. Friends with the sheriff. 2. The State Attorney. Seriously, I have no idea, fight my ignorance here.

Granted, it was a long time ago, but when I was arrested for DUI at about 2:30 AM, I had to be initially processed at one facility, then taken to another and processed there. But once that was over, I was released- that was about 6:00 AM. If I had been able to stay at the first police station, they would have released me to a sober ride earlier.

I can’t believe I’m hearing this from someone in a state which doesn’t exist.

In some places “concealed carry” includes an partially hidden, unsecured, loaded, handgun in the same compartment as the driver. A gun in the trunk isn’t being carried, but one in the (unlocked) whiskey box or console is the same as in a holster on your hip. Colorado has specifically changed the law to allow people to have a gun in their car without a CCW, but that’s just an exemption for the “concealed” part.

If he’d removed the ammo and put it in a separate compartment before he started boozing, he probably wouldn’t be in such trouble.
Based on my understanding of Colorado laws, which have nothing to do with him, of course.

Wicomico County is around Salisbury, or if you don’t know Delmarva, south of inland Delaware and extending west to the Chesapeake. Worcester county is along the Atlantic coast (the whole Atlantic seaboard of Maryland, from Delaware south to those two misplaced Virginia counties down at the tip, including Ocean City and Assateague Island, just east of Wicomico County.

We do legal blood draws for a lot of the law enforcement agencies around here. Generally, once the samples been taken the cops are done. Around here, they either go home with a sober person or go to detox.
