CarnalK–I mean this kindly: why can’t you just lighten up? One doesn’t read Sampiro for lucidity and information; one reads him for the pull of the prose, the peculiarity of his world and worldview, and the rollicking, sardonic zest of his humor. Like Monty Python or AbFab, some of its not supposed to make sense. Just roll with it. If you find you just can’t, and MUST have linearity–don’t read him.

I realize it got lost amidst the “Fuck you!” “No, fuck YOU!” “No, UNFUCK you, because you want to fuck me!” bitchfest, but take a gander at my post #47 on the first page. While you’re absolutely correct that Rick’s first step is the EEOC (few lawyers will take him on as a client before then), I doubt that the EEOC will find in his favor, for several reasons:

  • One, all the ADA does is equalize things between disabled and non-disabled people by allowing for “reasonable accomodation.” It doesn’t force employers to keep/hire people who aren’t able to perform “essential” job duties. For instance, someone confined to a wheelchair couldn’t work at my facility, because the job description includes the necessity of being able to physically restrain the residents. We don’t get protested by folks in wheelchairs claiming we’re violating the ADA, because they simply can’t do the job. (the overall lack of ADA-compliant facilities is a totally different kettle of fish, however) Thus, Rick’s employer did nothing to violate the ADA- Rick was given all the tools he needed to do his job, and with the exception of his absences he was able to meet the job requirements.

  • Two, unless this part was left out somewhere (though it seems precious little else was), and speaking as someone who just had to fill out those god-awful forms about a month ago, Rick doesn’t seem to have applied for coverage under FMLA. If you’ve ever seen the paperwork involved in FMLA, it’s not something you can use to take a day off here or there. Since Rick worked consistently with the apparent exception of the three listed days (the one he worked from home, the one he tried to swap out, and the one he woke up blind), he wasn’t actually eligible for FMLA in Georgia. No coverage = no violations.

  • Three, while “burning his bridges” probably felt damned good, the EEOC is not going to be sympathetic. Of course they’re supposed to be unbiased, and of course they’re supposed to go by the facts/law, but having dealt with the EEOC office that Rick will have to go to, I can say with a great degree of certainty that they will hear "And then he

and will immediately reach for the “no cause” paper. Never mind the “threat” that could easily be interpreted as “I’m going to climb a clock tower and you’ll be the first in my cross hairs.”

The only positive thing that will come out of an EEOC investigation will be a “right to sue” letter, which will allow Rick to go lawyer-shopping (in which case I can recommend an excellent firm in the area). But really, I think the best thing for Rick would be to sit back, collect unemployment, and spend some time with his family and friends.
