Breyer and Ginsberg dissent with the traditional “collective argument”
Stevens and Souter write a concurring in part and dissenting in part agreeing with the individual rights argument, but viewing that the outlawing of handguns only in an urban environment like D.C. is a reasonable regulation of that right.
Scalia writes the majority opinion, joined by Alito, Roberts, Thomas, and Kennedy affirming the individual rights argument and striking down the D.C. law as unconstitutional. They hold that a person has a right to own and keep a loaded handgun in his private residence, but leaves any other question about legalities for another day.
Thomas writes a concurring opinion blasting the Court for not going further and legalizing new machine guns and nationwide concealed carry.
