If you get something identical to what you already have then you have the peace of mind that the document will do what you want it to do.

I agree that you should have a lawyer give it a glance and briefly discuss with him/her how the law applies to your situation. Failure to do so now may lead to far more legal expense down the road.

That would mean it’s well done. Look at it this way. If you have messed it up, then it will cost serious money to get it fixed down the road.

Can the QCD be formally filed as part of the closing on the refinance? There might be some extra fees involved, but I can’t imagine this is all that unusual a situation.

I’ve heard that QCDs can be done with conditions attached, e.g. “I sign over all rights effective as of the payoff of the old loan”. Then if you don’t get the refi, she still owns her share of the house.
