No it isn’t, since any reasonable definition of theft requires harm, which you admit may not have been done. It’s only theft if there’s lost revenue, since the only other thing stealing removes is your ability to use or sell your product.
Also, it’s fairly easy to get around the problem with ISPs. For one, you can use a smaller ISP (as I do). For another, you can use a $5 per month anonymous proxy. You can also use other software that attempts to hide you, but those above are pretty foolproof.
I tell you this, not because I want you to break the law but because the system is rigged where you are guilty until proven innocent. You can’t even appeal any warnings that don’t have penalties. It’s essentially the first step in corporations taking over the governments role and thus taking away your freedoms.
I’ve a feeling that mere use of bittorrent is going to be used as evidence you did something illegal, as it’s so easy to detect, unlike actually monitoring content to see if its copyrighted. Even if you don’t do anything wrong, I think it’s prudent to take precautions like those above.
What bugs me more than anything is how this has been in the news forever, with all the objections, yet there’s no massive influx of people moving to previously smaller ISPs. It’s like people actually believe this will only be used for piracy, even when the DMCA notices haven’t been. You know, the same argument that shot down SOPA.
It’s also a rather easy attack vector. If I know your IP, I can ping the problematic sites using it, and even though I won’t get a response, your IP will be on the logs.

I was asking these questions because your reasoning is completely lax. By the logic you employ here, if you get the permission of someone else to use something, it’s okay for you to use it. Nevermind that the person who uploaded the content you downloaded did so against their legal agreement with the copyrights owner. So it’s okay to steal cable if the person whose cable your splitting knows about it, but not if they don’t, even though it costs them nothing in either case. But it’s okay to use the content provided by someone for free without their knowledge. You don’t see the logical breakdown here?

First of all, your scores on state standardized tests in grade school and high school have to do with your moral reasoning. There are plenty of extremely intelligent people who have terrible morals and plenty of average and less than average people who have nearly flawless morals. Second, claiming you scored 95% on standardized tests in high school isn’t going to impress anyone here, there are plenty of people here with advanced degrees, can articulate their points without simply saying they’re bad at English while still claiming to be 91st percentile, and are able to make cogent and logically solid arguments.
