RIP Scalia

Um, congrats for you? Not sure what your point is here.

Hi, GulfTiger. Welcome to the SDMB. Just so you know, saying “I’d call you a motherfucker, but its against the rules,” is also against the rules. Please avoid this in the future.

No warning issued.

It saddens me that your hopes for this thread do not appear destined for materialization, Rick.

All nine of the Justices were elected democratically.

Herrera v Collins (1993)

I’ve often said - out loud and in front of witnesses -that while I would never wish anyone dead, if there was a hypothetical where someone HAD to die and I had to pick, I would choose Scalia. I think the combination of his political partisanship, his narrow orthodoxy, flawed critical thinking skills and his influential position made him a very dangerous man. I’ll go to sleep tonight feeling a little bit safer.

And he annoyed me when he got snarky about hippies in his Obergefell dissent … although I have absolutely no doubt that when he said " ask the nearest hippie" he was looking straight at RBG.

Are you surprised?

The sad thing is that when Ruth Bader-Ginsburg (or any of the other “liberal” Justices) dies the idiots over at Freep will be exactly as gleeful as what we’re seeing here, but the hue and cry over their behavior will be deafening.

Scalia was an excellent Justice who was well-liked by his colleagues (especially Ruth Bader-Ginsburg). He was party to decisions I didn’t care for, but then again, they all were. Nobody gets everything they want out of the Supreme Court.

And in the end, the court was pretty much neutral anyway. First O’Connor, and then Kennedy, largely stifled both extremes. Roe is still the law of the land. Affirmative action is still permissible in college admissions. Same-sex marriage is legal. Miranda is still in place. All of the malice you impute to the man was for naught. And yet, he was a product of his time and upbringing, which in this country leads to gradual, incremental changes. It always has, and it always will. In the end, there’s no reason to hate the man.

nm Really, nm.

Oh what a white-washing crock of shit.

Disliking hate of RBG makes hate of Scalia hypocrisy? Bullshit. Al Qaeda was sad when Bin Laden died and will cheer when Obama dies. That doesn’t mean I should feel any remorse in acting the opposite way. In fact I feel more justified on being opposed to those freeper fucktards.

No reason to hate someone that equates gays with pedophiles and spent his life actively repressing tens of millions of my countrymen? Well, you have a funny way of looking at the world.

He actively made the country a worse place, and increased the amount of human misery in it. Am I happy he’s dead? No. Am I happy he’s lost the ability to hurt others, yes.

Sadly, there is no hell for him to burn in. He died rich, powerful, and convinced of his own brilliance. So he really won there.

As to Scalia’s death, I feel about as sorry toward his as he’d have felt toward mine. I hold the same prospects as to his eternal reward as he’d have felt toward mine.

As to the job vacancy, I’m jubilant.

As to his family? He died at 79 of natural causes, continually the beneficiary of government healthcare. I hope I and everyone in my family are as lucky.

I only hope he can see from the great beyond the final accounting of his legacy, and what happens after his demise.

Two different thoughts. The first one is that you got whooshed by Tripolar. Go back and read his post again. He’s known to be a very sarcastic fellow.

The second thought had noting to do with you. Next time I’ll leave a bigger space between thoughts.

I have in my possession several bottles of a BPAL perfume oil called “Ask The Nearest Hippie” (patchouli, hemp, vanilla bean, and cannabis). I shall dab some on my pajamas tonight and dream sweet, sweet dreams.

I agree with many of the sentiments above and reconciled my confused emotions.

I am not happy he is dead, and I am sorry for the personal loss of those around him.

I am happy he is no longer a force on the court, not for political differences per se, but for my hair-spitting perspective that his blatantly political actions were extraordinarily harmful to the country in the abstract and people in the concrete. As contrast, I did not agree with many Rehnquist decisions, yet I did not hold contemptuous view of him as a jurist.

Scalia was not alone in championing the empty rhetoric of originalism, yet he helped throw that emperor’s cloak over many eyes. He was not alone in politicizing the judicial process, yet he was a great outlier in diluting the court’s clout and appearance of impartiality. I found a lot of his judicial reasoning specious and his underlying rationale repugnant.

I am relieved (assuming Obama successfully appoints someone) and joyful at the possibility of a more balanced court. Yet in the same way that I don’t want a left-wing network that follows Fox’s malignant blueprint in a rise to prominence and influence, I do not want his successor to be the anti-Scalia. Although I am ‘sure’ that Obama could nominate Reagan’s Ghost and the right wing machine will label him as the most extremely left-wing nominee ever, I nonetheless hope that Obama selects a moderate with so-called progressive views in areas such as civil rights, inequality, the Fourth Amendment and a few other areas, I hope the eventual nominee mostly defies easy prediction of which side of an opinion he or she will fall on.

Scalia used his role on the SCOTUS in ways that were bad for the country. I am very happy that he is no longer able to do so, but not happy that he is dead.

None of the justices were elected. They were appointed & approved by elected officials, per the U S Constitution.

Which upset My Jr Senator back in July:

Cruz just expressed his opinion that President Obama should not nominate a successor–before Scalia’s body was cold. For a prodigy who supposedly memorized the Constitution, he seems to have comprehension problems

I’m glad Scalia is gone. For his family’s sake I wish he’d retired to spend his final years with them.

And I too have a bottle of “As the Nearest Hippie”–only one of the fragrances BPAL named after Scalia’s purple prose:

Scalia was a bad person who damaged our country. I would have been fine if he’d retired and ended his days playing shuffleboard with Don Coreleon, provided he went away. Since he wouldn’t retire, I’m glad he’s dead.

Any man’s death diminishes me - is true, but you know what? sometimes it’s worth the hit.

You’re absolutely correct.

Why didn’t you call out GIGO for his statement, then? Because he’s on your side of the aisle, or is there some other reason?

It’s more difficult with a SC justice because while I’m really happy he’s off the court, gloating doesn’t seem right.

Some mysteries must remain mysteries.

Since I was not absolutely correct in naming that fragrance (“Ask The Nearest Hippie”), I’ll take this opportunity to supply a link to the Black Phoenix Alchemy Lab’s fragrances inspired by The Collected Poetic Works of Antonin Scalia. Including “Jiggery Pokery” & “Looming Specter of Unutterable Horror.”)

(This is not an advertisement!)

I’m glad he’s dead.

It’s nothing personal, it’s just that Supreme Court justices are appointed for life.
