Yes, it would have.
As terrible an institution as slavery was, the way to abolish it was to pass a law: in our case, the Thirteenth Amendment. Having a judge declare, in the absence of any particular legal authority, that slavery was prohibited would have been a terrible precedent – great in the short term department, but fatal to the cause of having a nation that works by government of the people.

I TOTALLLY agree. It’s insane that in our constitutional republic that all of the judges are still put in their positions because of birth decree or some watery tart distributing swords.
I don’t know why anyone would be against same sex marriage.
