AFAIK he has nothing to do with it. The HHS spokesperson in the article I read was not taking sides in the debate, just noting that state law requires the forms be a certain way and if they’re not the department won’t accept them. The same article indicated that California family law experts are divided on the question of whether this action would have any bearing on the legality of the marriage.
Late today, San Francisco sued the state seeking to have the marriages recognized. Also named as defendants are the groups who earlier sued SF to have the marriages voided.
The anti-marriage crowd lost another round in court today. The judge hearing one of the two cases refusd to issue an injunction againt the issuance of licenses, saying they did not prove irreparable harm would result. The case will now be combined with the other case that was filed at about the same time.
