I have no problem with the death penalty when we are sure of our facts. My opposition to it stems from the poor job of defense, and the use of less than perfect information. Killing someone due because prosecution did a great job of selling it to a jury, and not because you had a smoking gun, bothers me.
I put down not sure - because there is a plea deal. If there is a plea deal, you follow the deal. I don’t know why they went for a deal (hence my unsure status) - but I assume it was offered and accepted for some reason.
“Some reason” could run the gamut from “we don’t want to be killing an American over any lost Afghani lives” to “he was so nearly certifiable that it would be hard to convince a jury to give the DP” tho.
Do you really think all possible reasons for excluding the DP are equal?
I am against the Death Penalty as a matter of policy, but since we do have a death penalty, this crime surely merits it. It is unjust that this man be spared while others have been put to death for less heinous crimes. Ideally though we wouldn’t have a death penalty at all.
I know it’s moot now.
Sorry - I did a poor job of explaining myself. My opposition to the DP stems from my lack of belief that we only convict the guilty. I believe (and there are certainly many situations uncovered by The Innocence Project) that we convict the innocent too often - so I prefer to take the DP off of the table.
In this particular case, guilt does not appear to be a question - but there was a plea deal. I don’t know enough detail on the plea and negotiation, but if prosecution and defense came to an agreement - I am OK with not executing him.
There is no way I would hand him over to the Afghans.
But everyone who voted guilty for the innocent people thought guilt did not appear to be in question. So I am opposed to the death penalty under any circumstances.
I’d be ok with putting him in solitary confinement for the rest of his life… and not feeding him.
Logically, I see no reason to keep him alive.
Nitpick: Afghani is the unit of currency in Afghanistan. The people are Afghans.
