On one hand, it’s an in for an unjust SCOTUS ruling, but on the other hand, almost literally anything is, and I’m sure prosecutors contemplated this point before proceeding.

As in the immunity case, the may take the case and string out the appeal process longer (which is still freckin ridiculous and a massive indicmenent of the GOP side of the SCOTUS on its own) but they will ultimately not find for him.

If I was a betting man this is how I’d wager they go. They can interfere just enough to make Trump’s other pending cases no longer relevant to the current election without setting a dangerous precedent that the POTUS has legal carte blanche to do whatever the heck they want without fear of repercussions outside of impeachment, which is something that could come back to bite Republicans.

Yeah, I mean just the amount of delaying they’ve done to this point is completely unconscionable, we may find out this week if they plan to delay further or if they’ve done enough.

But whatever happens they will almost certainly not find ultimately find for Trump in either immunity case or the NY conviction.

Bolding mine. I find it deeply concerning of the state of the US justice system that the speaker of the house is openly stating on a Fox interview that he personally knows Supreme Court justices and they’re deeply concerned about this.

While that is clearly disturbing (along with all the other GOP sycophants) that is just the world we live in right now Johnson needs Trump’s support against the “Freedom” (serious air quotes) Caucus. It all disgusting but pretty much business as usual for the GOP nothing surprising.

The GOP section of the SCOTUS do not, they are there for life. If they were going go to bat for Trump to that degree they would have granted his immunity. They haven’t so that’s a pretty good indicator of where they stand. The fact theyve heard his case and delayed it to this degree (and may delay it more) it outrageous, but it’s not an indicator they will ultimately find for him.

Apparently the way to restore faith in the US justice system is to get the Supreme Court to overturn any lower court ruling that Johnson or Trump doesn’t like. :roll_eyes:

That’s really dependent on where you are. Juries absolutely do set sentences in some places and courts.

You’re right that in NY, sentencing for criminal matters is done by the judge, except for certain kinds of murders, which are sentenced by a jury.

Are they sentenced by the jury or does the jury make a recommendation?

In a first degree murder conviction? There’s something called a “Sentencing Proceeding” where the jury decides whether it’s death or life imprisonment.
