The funniest part is that the Birthers lost because they demanded a ruling on the merits. Otherwise, they’d have a default judgment they could parade around claiming a win.

Obama’s lawyer refused to appear at the last hearing on Janaury 26th because he thought it was a bunch of garbage. The judge was not happy, but decided not to cite him or Obama with contempt, nor enter a default judgment against them. Just a finger wag, and no cookies after dinner.
If I were Obama, I would’ve asked my lawyer to be there just out of respect (even if misplaced) to the court, and to avoid any default. But all’s well that ends well.
