As far as I’m aware, the prosecution haven’t asked Huntley why all three of them went upstairs to the bathroom to treat Holly’s nosebleed. It’s purely circumstantial, but surely it would be more logical to the stay downstairs, say in the kitchen?
I guess you’re right, L_C; he might have pled guilty to manslaughter but the prosecution would likely have had none of that, thus necessitating a trial to determine the manslaughter/murder status of the killing, and indeed the 1st/2nd degree status of any murder. Personally, I cannot see hime getting far with the diminished reponsibility argument given his later sound-minded behaviour.
IANAL, but IIRC (WALOSA*) 1) causing a death in the commission of some other felony is still prosecutable as murder, and 2) “premeditation” can, in English law, occur mere instants before the commission of the actual act … it’s not whether he started out with the intent to kill, it’s whether he formed that intent at the time he actually did the killing.
