Stripping & the 1st Amendment

I was told th’ other day that stripping ( as in tease )

is protected by the 1st Amendment.

Can it be so? Cites anyone, please.

I am not going to cite case law (but I’ll bet you a nickel someone else will), but stripping and other so-called pornographic pursuits have generally been protected under the first amendment. This is because the freedom of speech is more broadly interpreted as freedom of expression, covering such things as controversial art (think Maplethorpe, Piss-Christ, etc).

Taking one’s clothes off whilst dancing can be seen as a form of expression.

Cite. In layman’s terms, no less. There are one or two earlier cases than the one described, which seemed to give greater protection to stripping. The current situation is quite muddled.

Nice site (and cite) Minty Green. I’ve added it to my favorites list.

I was raised in the Tampa Bay area which is like the Strip Club center of the Universe. So it’s nice to have something as a background note to read along with when the city and the Mons Venus start duking it out the next time.
