I’d settle for 10%. There are assholes out there, who I’ve overheard at ranges, who could not care less about the risks to life and limb involved in doing unsafe things with guns who WERE motivated in other aspects of their life by fines and potential jail time.

Man drinks all day, then conducts impromptu gun safety class for his girlfriend.

Well when a guy who was carrying his gun Mexican style (unholstered, tucked into the pants) and negligently shot and killed his girlfriend when he hugged her because his trigger got caught on something; you said that you would charge him with murder one. Murder in the first degree is a capital offense in places where they have the death penalty so they would be subject to the death penalty.

We don’t put most intentional murderers away for the rest of their life but you want to put people who negligently discharge their firearms in jail for life.

You also want to similarly put drunk drivers in jail for the rest of their life if they kill someone.

We already have laws that punish negligent discharge and we also have laws that cover accidental homicide. Its called manslaughter, in the sort of cases you are talking about, it would be involuntary manslaughter.

We can keep having this conversation but your position is not only extreme it is possibly unconstitutional.

What kind of talk are you overhearing at the range? My experience at gun ranges is that everyone is fairly safety conscious.

Not even in Texas do they execute even a fraction of people convicted of murder one.

When I go to my formerly-usual range (I moved fairly recently), in rural Pennsylvania, I hear and see all kinds of idiotic, crazy shit on a constant basis.

  • Targets labeled with politicians. (all Democrats, usually women or black)
  • Talk about how gun safes are a conspiracy to get good folks killed by home invaders (“A locked up gun ain’t a gun at all, by the time you get it out that $RACIAL_SLUR’s already shot you”)
  • Talk about how (usually with gratuitous spankings) to teach your kids to stay away from your loaded, un-secured guns.
  • Talk about how “hunting season” and “bag limits” are a liberal conspiracy and they should be able to shoot any animal on their property they want at any time.
  • Discussion of which rounds are most useful for stopping body-armored thugs–admittedly, never OPENLY admitting they’re discussing killing cops or homeland security types, just winks and nudges.

Get in a fight? Think the other guy is winning? Shoot 'em - make sure he’s dead! - and walk.

I don’t know what the law is in Texas but here in MN the shooter would probably be under arrest. And if I understand the article correctly the DA there could still bring charges.

Flee, actually, as he took off afterward and was “located later.” As did the loud-music crusader in Florida.

This may not be the optimal venue for a legal question, but after shooting someone dead in self-defense, is there no obligation to stick around? Bump bumpers with someone and then drive off = criminal, but blow someone’s head off and go about your merry way = no harm, no foul?

It’s the Flee Your Ground defence practiced by most gun owners when the shit hits the fan. I believe the handbook puts it something like this: “Whatever laws there are regarding guns only apply to you if the outcome is positive. Negative consequences for your careless and illegal actions are to be avoided because, dammit, this is all about you and not anyone else. Why the hell do you think you’re a gun advocate in the first place?”

The folks in Detroit who shot those animals were lucky (well, not lucky…smart)–they actually had some firearms to protect themselves.
