I am not an expert on Texas law but I think if the guy had been running from the shooter’s home with a TV he would have been on solid ground to shoot him. I don’t think you can defend someone else’s property.

Edit: Here is the applicable law. Does not say it has to be your property but there are a bunch of qualifications.

Texas is Texas, but it shouldn’t be legal to shoot someone in the back for theft.

A 10-year-old boy in Milwaukee shot and killed his mother last week. He was apparently angry that she had woken him up early and that she wouldn’t let him buy something on Amazon.

After she was dead, he logged into her Amazon account and bought an Occulus.

Abuses animals.

But think of how many burglaries they thwarted by having a gun in the home.

The kid is obviously already a sociopath and needs extensive mental health treatment but I’m not sure he needs to be tried as an adult and possibly sentenced to 60 years. He’s 10. Just from this

it’s clear he had no concept of the consequences of his actions. His brain isn’t even fully formed at that age. Yes, he needs to be kept away from society for a long time and hopefully given a chance to get much needed mental help. But to just throw him in prison for basically the rest of his life? That’s going too far for a 10 year old.

For additional punishment, he forfeits the Occulus, and is issued a Gameboy Advance and a Zune.

But he gets to keep the gun.

Why not attempted murder?

Well, he did get the kid in the leg, so not aiming for center of mass.

And if an artery was hit?

And he bled out? Yes, then upgrade the charges to murder or at least negligent homicide. But I’m guessing the current charges are based on that sort of reasoning. Mind you, I’m in no way condoning it, just trying to understand the charging decision. Also, it’s early days in the case; the prosecutor could seek attempted murder charges in the grand jury when seeking formal indictment.

I think that anybody with any firearms training knows this. I know it and I’ve never owned a gun.

Same. I learned it here on the SDMB, from Doper gun owners repeatedly referring to it as an elemental aspect of gun safety. Always assume all guns are loaded, and never point a gun at anything you don’t intend to shoot.

None of my business, but I kind of wonder if this was actually a roommate feud and murder now being covered up as an “accident”. How does anybody who shares living quarters with a deputy LEO not know at least that much about gun safety?
