Congress, the judicial system, the bureaucracy, the governments of 50 states and assorted territories, to name a few.
What makes you think Trump can tell state governments how and to whom to issue birth certificates?
Keep in mind while answering that if there is no birth certificate then there is no proof of parentage, and foundlings are US citizens by default unless it can be affirmatively proven that they were born somewhere other than the US.
Did you see what I said above about his excuse for that? He’s going to declare that’s not within the state’s perogatives as citizenship is a determination of the federal government.
Right. The current Supremes turned the constitution into naught but a rag with their decision regarding Trump and his legal liabilities. That decision is pure and unmitigated nonsense. Remember in the run-up to impeachment, the pubbies said the proper venue to pursue those charges is via the courts. Then when that happened, the pubbies said the proper venue to pursue those charges is via impeachment. And the Supremes just abrogated the impeachment clause regarding the president anyway.
@Smapti You’re talking about the legal situation now. Aren’t you aware that Trump and his enablers want to and wiill do what they can to change that?
Which, from a legal standpoint, means fuck-all. He can declare that the 79th element on the periodic table is now called Trumpium for all the effect it would have.
“What they can do to change that” is nothing. Birthright citizenship is explicitly guaranteed in the Constitution and there’s not going to be any amendments in the next four years. Any attempt to legislate a change in citizenship law is impossible because Republicans don’t have 60 votes in the Senate. And any attempt to overrule the law by presidential fiat will not survive judicial review.
Yeah-huh. So when Trump declares “ALL YOUR BIRTH CERTIFICATE LAWS ARE NULL AND VOID, ONLY I GET TO DECKDE WHO HAS BEEN BORN”, you expect the state of California’s response to be what, exactly?
No, I don’t expect that it’ll happen at all. Our government does things slowly almost by design. The legal challenges to such an act would not be resolved by the time we have another Democratic president.
Every single time one of these arguments comes around it always boils down to “Trump can do whatever he wants and nobody can stop him”, which, aside from that being exactly what he wants people to believe, is simply not realistic.
Does that sound better than “Trump is completely ineffectual and is easily stopped”, or “All laws enforce themselves”? Frankly, I am damn glad that there are people prepping for when/if the shit hits the fan instead of just saying “Don’t worry your pretty little heads about anything-nothing can possible go wrong”.
