I believe you are correct. The committee failed to make a proper motion. It’s on them.
They were presented with the opportunity to ask questions of Hunter Biden and failed to take actions with proper procedure. Were they just stupid? Possibly. Or did they not want to make the motion, because they have another purpose for this whole sad clown show? Most likely.
In this particular committee, Comer rarely will allow a vote to happen, motion or not. The members of his caucus tend to show up for their 5 minutes of questions and then fuck off to be on Fox News or right wing YouTube shows. There’s almost never a time where there’s enough Republicans present to win a vote, so Comer never calls one.

On one of those clips, I heard someone assert that the motion (to question him then and there) was “out of order.” Coulda been the committee chair, coulda been someone trying to be a junior mod.
ISTM that he’s free to go anyway. They didn’t summon him to that particular hearing, and absent their decision to place him under oath (or even to place him in the hot seat), they don’t have the privilege to grant or to withhold dismissal.
The fact is that he placed himself at the committee’s disposal, and the committee did not see fit to take him up on it.
