Okay I have a question. It feels naive but I honestly can’t come up with a good answer for this. I’m hoping others will. Or maybe I’m just missing something.

I recall the arguments from back when the Supreme Court decision concerning presidential immunity came down that it was speculated that even if the president couldn’t be held responsible for illegal actions taken under the banner of executive authority that people under him that he ordered to take illegal actions could still be held responsible.

Do we have any idea why this isn’t being done yet? It seems to me that the administration is flouting the rule of law in the most blatant and egregious way possible. Maybe nothing can be done to Trump directly. Why can’t the people directly carrying out his decisions be held accountable? Are they all being protected by the same supreme Court decision? Is this a literal “they are just following orders” situation?

I may not be a lawyer but I do understand the idea that the law can only be upheld as long as all of those involved in the system agree to uphold it. I find it hard to believe that when any other offender that wound up in court would be held in contempt for doing half of the things that this administration has been doing just in the last few months, that they wouldn’t be held accountable in some way. Somebody needs to start spending some days in jail until compliance is enforced. Why isn’t this happening yet? Is it likely to happen in the future?

Who would prosecute them? Who are these prosecutors currently working for?

Maybe someday, but I am not optimistic.

Anyway, Trump could just pardon them, and keep pardoning them.

It looks like the answer to whether he can pardon contempt of court is “probably”, but it’s not settled law that a president can pardon civil contempt of court or contempt of Congress.

But, the extreme scrutiny and willingness to detain people, like happened here and with the British girl, rather than just put them on the next flight home, seems new.

As I keep saying, one of the most disheartening parts of it is how it looks like so many in CBP and ICE are not just obedient but eager to act this way.
