Court of Appeals strikes down the government’s appeal of the district judge’s order in the Garcia case. Reagan-appointed J. Harvie Wilkinson wrote for the unanimous opinion.

“It is difficult in some cases to get to the very heart of the matter. But in this case, it is not hard at all,” Wilkinson wrote.

“The government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order,” he continued. “Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done. This should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear.”

Some good language in that appeals decision. Now teed up for the Supremes!

Bottom line: no court, up to and including the Supreme Court of the US, can make trump do anything. “Contempt of court” to him is just so much white (excuse the expression) noise. He might throw an underling or two under the bus, but there will be no tire tracks on him.

Ultimately, asking what would happen in such a circumstance is like consulting the Monopoly rulebook for instructions about what to do if somebody flips over the board. At that point, we are playing a different game.

This metaphor was thrown around on this very board during trump 1.0, along the lines of, “trump doesn’t play by the rules–he just flips the table over and all the cards and chips go flying.”

Of course this was obviously going to happen.

Perhaps - just perhaps - there is some recognition this man is not a dangerous criminal and he’s being treated humanely.

I fear it more likely he was cleaned up and clothed for a photo-op.

I mean, if there ARE some people being sent to this prison who aren’t hyper-dangerous criminals then holding them in less harsh conditions may well save El Salvador money… if El Salvador is doing this strictly for profit. We already know some in the US are doing this for the cruelty.

Yeah, photo-op.

I still hope he’s going to be OK in the end.

Apparently they are scrambling to do more no-due-process deportation flights, presumably before the courts can step in.

Reminds me, of all things, of Nazi Germany scrambling at the end of WWII to kill more Jews, even as it took resources away from the war.

Why is doing evil so damn important to them?
