These two songs sound so alike, how is there not a lawsuit?

I know the subject of sound alike songs have come up before but this one was so striking, I had to ask.

In an effort to get me to like country music, a friend of mine suggested Little Big Town. I listened to Pontoon and liked it. Then came Girl Crush. Is this song not EXACTLY like Bonnie Tyler’s It’s A Heartache. Where’s the lawsuit?

P.S., Little Big Town’s girl singers should also go to style court for the nude and pink lipstick. Stop that nonsense!

Maybe it’s just me, but I’m not hearing any resemblance between those two songs.

The resemblance is that they both bore the hell out of me.

I can see that there might be a little resemblance. But if someone suggested that song as an introduction to Little Big Town to me, there is no way in hell I would listen to any more. They might be good for all I know, but that song is a snoozefest.

It’s similar, but not terribly so. Does it really sound identical to you? I’d have to see the sheet music to be sure.

I think Alex North could get in there 12 years prior; that guitar progression is lifted right from “Unchained Melody”.

I’m thinking more the melody than the progression. I don’t think you can protect those.

While they’re at it, they may as well sue The Sutherland Brothers for “Sailing” (1972), or Rod Stewart for his cover version which was much more popular.

(Side Question: If a popular cover version of an obscure original song turns out to have plagiarized an even earlier song, who gets sued? The original artist or the cover artist? Imagine if George Harrison’s “My Sweet Lord” went unnoticed until someone like Lady Gaga recorded a platinum-selling cover version…)

You’d sue the songwriter. If you are awarded royalties, then you get a cut of any later covers.

The melody lines are actually fairly similar. (And I’m actually surprised, because usually in these “don’t these songs sound the same” threads I hear very little similarity. This one is, to me, fairly strong.) There’s a third song, though, that both remind me of, but I can’t place it, and it’s not any of the other songs mentioned in this thread (which don’t sound similar to me at all.)

The beginning of ‘Girl Crush’ kind of resembles the chorus of Sarah Machlaclan’s ‘Angel’

I would have to plead ignorance as I’ve never heard of “Girl Crush” before. Is it a hit? If it wasn’t and didn’t make any money, then I doubt there is anything really to go after monetarily…

Yes, it was pretty big. See here. Two Grammies. Country Music Association song and single of the year. Number one on the country charts, and peaked at #18 on the Billboard 100. Over 2 million sales in the US.

Yeah, the melody is really close. Much slower but close.

And that must be the most soporific song I’ve heard in years.

The first line of each verse is pretty much identical in melody, but the tunes gradually depart with the second line being similar in feel but not the same, and subsequent lines being more and more dissimilar.

Awesome rant, but he’s wrong about the violas. I’ve played Pachelbel’s Canon on the viola, and it sucks. It sucks different from how the cello part sucks, but it’s still ten pounds of suck in a five-pound bag. Of suck.
