I’m all for stopping satellite piracy, but this is just insane!
If I was getting sued by DTV and had only bought hardware, I think I’d be looking for a cite on a case a few years ago where people were getting busted for buying grow lights out of High Times magazine. Trouble was, they were growing chile peppers.
Of course there is a degree of separation buying from an advertiser in a mag vs buying from a site catering to TV pirates, but still…seems a little far fetched to my non-lawyer way of thinking.
If you buy beer, are you guilty of driving while intoxicated? No, you have to be actually caught driving…while…intoxicated.
Buy a pistol from a pawn shop makes you a murderer?? No, you have to murder somebody to be a murderer.
I must be missing something in the line of thought re intent.
Scare people into paying up?? Hey, there’s an idea!
It ain’t about justice, nor has it been for a while.
Nowadays, it’s all about whether or not the other guy can afford to sue you.
And in dealing with corporations, it’s how much of your life and fortune you’re willing to throw away while they stonewall you with their army of lawyers…
First, it’s never been about justice, it’s always been about process. Second, there isn’t anything magical nor especially expensive about federal court. If I had done nothing wrong, I would not be sending off $3,500 checks to settle a threatened lawsuit. I don’t have much sympothy for someone who caves in when they get a random letter in the mail. I’d fire one right back and mention good old Rule 11, and the perils of filing a lawsuit unsupported in fact. And no, IANAL (yet).
It certainly sounds like extortion to me, even if it is privileged.
I can kind of understand the point of view of someone who settles for $3500 to avoid years of expensive and stressful legal wrangling.
