No kidding. Dominion has multiple pieces of written evidence that Fox executives absolutely knew it to be false, and broadcast it anyway.
Slam dunk. The only question is the amount of damages. And Dominion also has excellent evidence of fiduciary harm caused by Fox.

It would explain so much. I can see it now. He gets inaugurated in 2025 and immediately after, pulls off a rubber mask ala Mission Impossible and says, “Thanks for all the cash, suckers!”
Depends on the state. Texas (natch) definitely. The Sandyhook parents who sued Alex Jones there ran into that. Other states not so much.

The nice thing about punitive damages in no-limit states is, it has to be an amount that really punishes and hurts the entity that caused the harm and discourages them from committing such an offense again.
Think what a huge number that could be for Fox.
Can Fox be ordered to fire certain on air hosts?
It seems unlikely to me, although I suppose Dominion could ‘insist on it’ as part of a hypothetical settlement agreement.

I don’t see how, but they might do it voluntarily as part of their rehab efforts.
I think they’re toast either way. If they don’t feed their deranged audience the things they want to hear, the audience peels away to another network that will. (RT?)
If they continue to lie on air, these cases will become more frequent and other entities such as the cable providers that carry their channel will drop them from their lineups.
Consider also that when if malicious intent is found to be true, then that opens the door to endless new civil cases being brought against them. E.g., all the 140 Capitol police who were injured on January 6th. For that matter, January 6th attendees who suffered criminal prosecutions because they believed what Fox was selling when they knew the information was false.
It’s not a small list.
If only there was capital punishment for corporations (which are people, my friend, after all). Fox could be charged with deliberate crminal negligence in the death of that woman in the January 6th fiesta, have its charter revoked and all its assets seized by the government.
Could I ask that the Fox Logo be put in a Gibbet Cage, and hung from a yardarm on Wall Street as a warning to other capitalist corporations?
I’ve been operating on the assumption that Tucker Carlson is just Phil Hartmann in disguise, in an updated version of his “Unfrozen Caveman Lawyer” persona. “I’m just a rich white douche! Your ‘normal demographic change’ frightens me! Now get me a scotch!”
I just really wish that Fox had to change its name to Fox Entertainment Channel and run a permanent banner stating that all of the hosts were entertainers, not journalists.
