I was volunteering at the library today, and every Monday for now, there’s a group of volunteers who are doing taxes for free for qualified people. There was a borderline-elderly woman walking around while she waited her turn (who, FWIW, smelled like urine) talking to everyone about, in short, Hunter Biden’s laptop and his links to Ukraine, and how she learned about this on Fox.
I kept my mouth shut, and not just because of the way she smelled.
So how long until Fox is reporting “Judge rules in favor of Fox, denies that we acted with malice!”?
And do plaintiffs typically suggest an amount of punitive damages? If I were a juror, and wished to “deter the defendant or others from similar behavior”, I’d want to set the amount of punitive damages at the total value of the ad time sold in the shows that repeated the lies… but that’s a number I don’t know, and I don’t think juries are allowed to do outside research on such things. But it’s something that Dominion’s lawyers could easily have researched.
If I were on the jury, I’d set the award at the Market Cap of Fox news; 17.10 Billion.

IANAL, but I asked my buddy Google. From what I can tell, a plaintiff can ask for punitive damages, and in so doing they would argue for why they are warranted (showing evidence of malice, direct harm, disregard for the law, acting recklessly) but the actual amount is reached through a calculation done by the courts.
Also, it seems that punitive damages are rare; they are awarded only about 5% of the time. So when you hear of them in a case (like the Alex Jones lawsuits) you know something pretty egregious happened.
Exxon dragged their tanker through the court system, first being hit with $5B in punitive damages, then getting it knocked down to $4B, then bouncing it around until it finally came out at half a billion. I guess they had a good legal team (and judges holding significant stock shares in the company).
I’d be satisfied if they had to announce after each story, “What I have just said might or might not be true but in either case was designed to get you riled up and make poor life choices.”

Is it possible for both sides of a court case to somehow lose? Because there definitely should be no winners here. I find it disgusting that she still cannot admit to promulgating lies, and that she claims, ludicrously, that it took her a long while to “draw the dots” between her shows and what happened on Jan 6th.
