This law is not heavily enforced. It’s not an uncommon sight to see someone drinking a beer in the car next to you.
The drive-thru Daiquiri shops still exist here but they’ve never been allowed to punch the straw through the lid before they hand it to you through the window.
As long as the driver doesn’t punch the straw through, it’s a closed container. Once the straw hole has been broken open, it’s an open container.
I gotta go with this camp, as well. I’ve been known to start a beer before a game or something, realize I had to leave to make it on time, slip the open beverage in a can coozie, and head on out.
Not everyone is a Two-can Sam. One beer isn’t going to make someone a slobbering drunk.
I’m more annoyed by people who engage in cell phone conversations and fail to notice the 4 way stop sign as they coast through it and turn left then get pissed at me for almost getting hit in the door. Someone drinking a cold beer on a hot day in the car next to me rarely phases me. Especially in creeping traffic. I’ve seen and smelled worse from the car next to me, and at higher speeds.
