They won’t. They have no jurisdiction to act on behalf of Manhattan. Extradition would have to be pursued. That won’t go well for Trump if he puts himself at the mercy of DeSantis.

DeSantis is stupid. This would’ve been his chance to get on top and steal the Autumn Fans.

But we’ve got some months ahead of this. Hopefully more damming testimony for Georgia and J6 is part of the waiting.

I heard it’s a routine procedure between states. And I suspect the Governor of Florida would get a kick out of turning a certain suspect over to New York for a Criminal trial. I can see the Secret Service and maybe even U.S. Marshals might get involved. Or at least updated.

He might; OTOH, doing so would also likely deeply anger the MAGAts, whom I imagine DeSantis is hoping to attract for a Presidential run.

In general, it is. It’s very routine. But did you not hear that DeSantis came out with a tweet 5 minutes after news of the indictment fell, declaring he was going to not cooperate with an extradition proceeding?

I agree with @Locrian. DeSantis made yet another dumb move. He may think it would allow him to keep Trump under his thumb in Florida while he goes out a’campaignin’.

But the net result to Trump would be to get hauled out of Mar-A-Lago as soon as federal charges are filed and treated to the Full Monty: Handcuffs, orange suit, held in jail pending further proceedings. When the Feds are done with Trump, they’ll still turn him over to Manhattan to finish their case – to which they will no doubt add additional charges for ducking extradition.

Can anyone confirm that measuring Trump’s height and weight is a part of the booking procedure, and that such measurements are a public record? If so, I predict an Orange Anus meltdown when they ask him to step on the scale.

They NYPD has 36000 officers. Can they send a bunch of them down there to get him?

It’s my understanding that all states are required to comply with a lawful extradition request but are they required to assist or can they say ‘you can have him, but you have to come get him’?

I don’t believe that they have jurisdiction outside of New York City (and certainly not outside of their state). Hence, the need for working with the government and law enforcement in the other state to achieve extradition.

There are four reason a Governor can refuse to cooperate, accord to Wiki:

  2. the person has not been charged with a crime in the demanding state;
  3. the person is not the person named in the extradition documents; or
  4. the person is not a fugitive.

Georgia can sue to have the federal government enforce the extradition. Florida is generally required to comply by state law (Uniform Criminal Extradition Act), federal law, and the U.S. Constitution itself. There are few grounds to contest extradition, however this case is particularly weird… it’s an alleged violation of NY state law to falsify records to conceal a crime, but the underlying crime is apparently federal (I think??? Does that count as being charged with a criminal offense against New York, for the purposes of Florida law or federal law?), and something not clear to me - was Mr. Trump actually in New York at the time of the offense? DeSantis can say he won’t comply because interstate extradition laws require the person requested be a fugitive from justice, and if Trump wasn’t within New York’s jurisdiction during the time he was alleged to have offended the state of New York, it seems an open question to me whether he can be considered a fugitive from justice.

On this latter point, if DeSantis says Trump is a fugitive from justice, I’m quite confident Trump would have the burden of proving he isn’t subject to New York’s jurisdiction (in habeas corpus proceedings). If DeSantis says Trump isn’t a fugitive from justice, I think Georgia would have to sue Florida and have the Supreme Court (original jurisdiction) settle the question.

Also, either way, Trump would never be able to set foot in New York again or risk being arrested. It’s way more likely he surrenders himself.

How does house arrest work for a resident of another state?

Florida’s on the east coast; for example one could fly east MIA->CMN->DME (Miami->Casablanca->Moscow) without passing over any other U.S. States.

That’s my feeling. I think his lawyers are, even now at almost 2:30 AM in Florida, telling him (and not with tears in their eyes) that, “Sir, just surrender. Fly to New York, go through the processing, enter a Not Guilty plea. We’ll have plenty of time to look after what comes next.”

“But what can we do to delay? I mean, I always manage to delay. Make a motion or something.”

“Sir, we cannot do that until after the arraignment. Then we can make a motion to dismiss. But we can do nothing now.”

“Well, I’ve got to be able to sue somebody over this. Hell, sue Bragg! Get the paperwork going!”

“Sir, we can do that later. [Not sure if he could, but such a belief would keep him content for now.] It would just be easier if we go along with what New York wants, and we can attack the New York DA’s arguments–and the New York DA–later.”

Quick question: could New York actually just send someone down to get Trump, rather than waiting on extradition? I know the feds could, but I don’t know if a state can just send their own people.

Agreed, with the additional observation that if it does help him win America deserves what it gets, good and hard.
