I agree the texts are probably gone. But if pics were involved, who knows? Trump was somewhat of a celebrity back then. So I can see it going like this:
“Hey, Alice, I’m friends with Stormy Daniels and she sent me a pic of Trump’s dick. You want me to text it to you?” … (Later) “Hey, Butch, you know that friend of mine who’s friends with Stormy Daniels? Well, she sent me a pic…” Etc., etc.
If there were hundreds of copies of the pic shared, I think there’s a good chance there are a couple still out there.
Plus, of course, it’s certainly possible that one of the original recipients collects Celebrity Dick Pics.
Because they are renting, not buying.
I think that if the picture was taken 10 years or so ago - in the pre-cloud days- it’s likely that it was stored on a computer somewhere. And a lot of people just move everything from old computer to new computer every time they upgrade.

It is based on the podcast ‘Stormy Daniels is a legal genius’.
I can’t just cut and paste the entire post, but suffice it to say here is a synopsis:
Either Trump admits he isn’t the person in the NDA (meaning Stormy is free to talk about Trump) or he is the person in the NDA.
If he is the person in the NDA, the NDA is invalid because adultery is a crime in NY state. NDAs can’t cover up crimes. Trump also opens himself up to fraud and obstruction charges in this case.
Basically, the claim is there is no way the NDA is legal. Either it isn’t about Trump, or if it is it was used to cover up the crime of adultery in NY state (making it null and void). Plus since Trump can only pardon federal crimes, he has no recourse against being charged in NY state for fraud, obstruction and possibly using campaign funds illegally.
Also they brought suit in a way that makes it hard to throw the case out.
Does anyone know if this is all true? I hope so. If Trump and his attorney are getting their asses handed to them by a porn star and her attorney, imagine what Mueller can do.
I think it’s mostly about her new attorney being a badass, and that she shopped it around until she found somebody good who’d take the case.
It’s sounded to me like the encounters between Daniels and Trump (if they occurred) didn’t happen in New York. In digging through a few articles, I see mention of Lake Tahoe, and the bungalow at the Beverly Hills Hotel.
I also seem to recall that their interactions allegedly centered around a period of time when he was in Los Angeles for filming of The Apprentice, when it was moved there from New York.
IANAL, but if he committed adultery, I don’t know if his state of residence is relevant; my suspicion is that the state in which the act occurred would be where the laws would apply.

There are billions of reasons. Allegedly.
But unless it’s a full-length photo including the face, and not obviously Photoshopped, how would anyone know who it is? Of course if he then wanted to maintain that it wasn’t him, that might raise the entertaining prospect of himself having to submit to inspection under cross-examination.
If Stormy released a pic of a HHUUUGE wang, trump will of course say, “yep that’s me”
Treason, Obstruction of Justice, money laundering seems OK with our congress. AND is OK with the people that voted this asshole into office.

Per some of the posts above, it’s less about adultery, and more likely going to hinge on the campaign finance violation, which appears to have been paid (based on her lawyer last night on CNN) out of Cohen’s NYC office.
Of course, and IANAL, if Cohen really did mortgage his house for the payment, and they can’t connect it directly to campaign funds, it sounds like he’d be the one going down for campaign finance violations, not Trump.
