Two crimes, or one?

Hypothetical person A is an undercover police officer, posing as a prostitute.

Hypothetical person B is a man preparing to solicit that prostitute.

If B solicits A for sex, that’s a crime, sure. If, during search, B is discovered to have no money with which to pay, is that considered a second crime? Fraud?

The subject came up while working on the deck over a few beers. What can I say?

Its usually used as a defence to argue that they weren’t really serious about soliciting in the first place. I have a hard time seeing how it could support a conviction for fraud as it is an illegal contract in the first place. We are generally allowed to lie to get laid.
