US Constitution, Constructionism and the 9th Amendment

Here’s a head-scratcher for the strict constructionists. What do you do about the 9th Amendment?

There was a thread adressing this recently (9th and 10th amendments). I did a search but somehow couldn’t find it. It was a few weeks ago max.

We’ve banged this around so much that I’m getting sick of it. I usually tell folks to search on Polycarp or my name plus “ninth amendment,” but it may be worthwhile to stick all the links in one place. Here goes (Poly and others: please add anything I overlook):

Rights? What’s a Right?

Is Scalia Nuts?

Supreme Court hears challenge to Texas Sodomy Ban

Conservative dopers vs. gay sex decision

Democrats oppose Hispanic judge: “he’s too competent!”

Strict constructionists: How about adding a constitutional “right to privacy”

Granted, the topics are kind of far-ranging and the ninth amendment discussion is buried amongst them, but there’s good discussion in there.

This one’s not really on topic, but I’m including it here for reference’s sake:

Dewey! Minty! Come a runnin’!!
