I do see the humor, but I doubt that this would ever happen.
You don’t have a right to a Facebook account, certainly not one that survives you. AFAIK, Facebook can delete your account at will without recourse, which they’d probably do at the first whiff of a lawsuit just to be rid of the hassle.
