Ban flag burning? Protect abortion? Mandate casual Friday?
If you could be assured of successfully adding 1 amendment to the U.S. Constitution, what would it be?
As for me, I would pass an amendment that dictates that corporations are not people, and, as such, are not granted the due process protections the 14th amendment intended to apply to people (and, more specifically, freed slaves).
Moreover, corporations would be formed by public charter (that is, they operate with a license from the state), and are under obligation to behave in the public interest. Failing that, their right to exist can be revoked.
Go into court and prove that you are an irresponsible git without any brains or common sense and that you are unable to accept any form of personal responsibility for your actions…
…And you are henceforth stripped of your rights as a citizen and made a ward of the state. Where you will be protected and cared for and not need to be responsible for anything. (And no longer be free to roam around and cause trouble for others by your lack of personal responsibility.)
Of course, I can’t seriously back such a thing, because it could too easily be used by an evil government to strip dissidents of their rights.
I’d want an ammendment about privacy, above and beyond what the 4th gives. Not just secure in one’s paper, but also in one’s body, thoughts, private affairs (including who you marry or just have sex with) and so forth.
I’d support you if it had broader language. I won’t support anything that would specifically support gay rights, but something that supports the right to enter into a domestic union of any makeup you choose. I don’t think the constitution should have any non-universal language. No laws that apply only to specific subset of the population due to a short term political issue regarding that subclass. Basically, I do not think that gay rights will be a major issue in 40 years, and enshrining it in the constitution would only elongate what will largely be a non-issue to adults who are currently under the age of 25.
Section 1. After one year from the ratification of this article the use of the DesignatedHitter within, the importation thereof into, or the exportation thereof from the United States and all territory subject to the jurisdiction thereof for Major League Baseball purposes is hereby prohibited.
Section 2. The Congress and the several States shall have concurrent power to enforce this article by appropriate legislation.
Section 3. This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of the several States, as provided in the Constitution, within seven years from the date of the submission hereof to the States by the Congress.
I’d amend the 2nd Amendmant to clarify the language and make it crystal-clear to even the gun-grabbers that the RTBA is an individual right, as well as a collective one.
I’d include a right of basic health care, and an ability for 1/4 of either the states, or the population to initiate a recall election on the president.
Also campaign promises would be legal binding agreements, and failure to in good faith attempt to live up to them in the completion of a term would be a felony.
There are some serious Constitutional questions being raised about Washington DC possibly having voting representation in Congress, so I’d add something to ensure “No Taxation Without Representation” applies to the District.
I’d nullify the second amendment. I could do with or without it, but without will lead to less accidental deaths.
Right to privacy in big bold letters. I’d get my legal bright minds to word it such that sex, homosexuality, medicine, is all covered.
I’d get the ERA in there. Kind of symbolic at this point, but why not? I’d make it explicit that this means women get drafted and that gay marriage is allowed.
All statutory laws have an expiration date not more than twenty years from the date of effect. Existing laws shall expire twenty years after the ratification of the amendment.
