just curios what deformation of character is?
Are you sure you’re not referring to defamation of character? Which would be a libel or slander of a person’s ethics, or something along those lines.
I’m pretty sure you meant defamation of character.
Defamation is the the “act of injuring another’s reputation by any slanderous communication, written or oral; the wrong of maliciously injuring the good name of another.” (Dictionary.com)
So the key to defamation is to spread vicious lies about someone to ruin their good name.
Deformation of character is when a guy in a comic book changes shape. Link the Incredible Hulk when he got all big and green and stuff.
I thought deformation of character was when you took a captial ‘Q’ and just bent the shit out of it, yielding a ‘&’.
Har.
Defamation of character encompasses two different civil liabilities: slander and libel. Slander is the spoken work promulgated to 3d pties or a 3d pty. Libel is the written word so promulgated.
Case law in the different states vary as to the defenses. In some states, truth is an absolute defense, but in other states, even if true if done with malice, the action will lie.
“Slanderous communication, written or oral” is a contradiction legally. Slanderous communication can only be oral. Libelous communication is written.
Trivia point: in the English & Welsh legal system, libel can apply without a third party ever being involved. In Scotland, libel must involve a third party.
