The book Intern by Doctor X, written before abortion was legal, says that any doctor who treated a woman for a miscarriage had to find some fetal tissue or report a suspected abortion, so they could lean on the female to name the person who did it. The first time the doctor was suspected of letting an abortion pass as a miscarriage, he was censored privately. Second time, publically. Third time, he risked losing his license.
Doctors and women were imprisoned in Romania when abortion was illegal. In many cases that was a de facto execution given the conditions of that country’s prisons. Why does anyone assume it would be that different here?
Did you miss the part where the article alleged that women who miscarry “could be investigated for and/or charged with attempted killing of an unborn child”? In other words, even if the ACLU is correct in this regard, the miscarriage alone would not be considered criminal behavior. At best, it would be treated as a sign that there might have been an attempted killing and that this might be worthy of investigation. Obviously, this is not the same as saying that miscarriage would be criminalized, as you alleged.
To cite an obvious example, somebody could be investigated if he happens to own an automobile that matches the description of a getaway vehicle. This is not the same as saying that ownership of such a vehicle would be criminalized. That’s just plain common sense.
Mind you, I’m not saying that I agree with the ACLU’s description of this bill. I’d have to read the fine details in order to make that determination. What I am saying is that even according to their liberal interpretation, this bill does not criminalize miscarriages, period.
