Do you really think a corporation that’s had celebrities sue them is going to post a recording sent to them by an 11 year old girl? Is there any sort of contract involved? Wouldn’t they have to verify with someone that she was who she said she was?
I think that’d be a lawsuit waiting to happen if that was the case. TMZ is owned by AOL. I can’t see a company like that dealing with a minor.

If gag order or confidentiality agreement extends to the parties, meaning Bassinger and Baldwin, then if the child didn’t keep things confidential she would not be subject of contempt of court because the court order did not apply to her. IOW, she is the subject of the case (or the custody element of it) but she is not a party to the case. It is possible the judge extended a gag order over all participants and witnesses, including her, but that isn’t likely.

I’m a little touchy when it comes to this sort of thing. Its real easy to take the self-rightous indignant position of whats right and wrong. It’s not so easy to be human.
And your definition of reality as something that “hits you on the head” doesn’t make it any easier.
So Basinger could conceivably use her daughter as a means to circumvent the gag order by leaking any embarrasing information through her? Pretty big loophole, I’m surprised judges put up with that sort of transparent defiance of their authority.
You’re talking about two different things. The first is the daughter releasing the information, and the second is Basinger using the daughter as a means to release the information. The first probably would not result in any consequences to Basinger because the gag order was not violated at her instigation; the second probably would for the same reason.
But how would the court tell the difference?
By looking at the evidence, if any. If Baldwin wants to make the argument that Basinger is in contempt based on her “making” Ireland release the recording – and assuming Ireland is in fact release the recording – then since it is Baldwin’s assertion, Baldwin has the burden of proving it. He might do so by tracing it back from TMZ, for example, or by convincing Ireland to admit her mom told her to do it.
But if he can’t prove it, then there would be no grounds for holding Basinger in contempt. There are circumstances in which a parent is responsible for the actions of a child, but contempt of court is not one of them.
That’s my point. Basinger can evade the court order if she is careful and her daughter is complicit.
Jodi - I do appologize for my outburst. In my lengthy scolastic career I have aquired a few sore spots, and this thread was tickling one of them. We are both in agreement that Alec Baldwin needs some serious help.

I could imagine a circumstance where he is in fact being set up and manipulated by his vindictive x wife and/or spoiled brat/poisoned off spring. And they are ruthlessly pushing all his buttons until he goes off. All the while he’s desperately trying to maintain contact with his child. I could see it happening.

Kim may have suffered this very sort of abuse or worse while married to this man and left to secure a better environment for her and her daughter. Perhaps her daughter is screaming to not have to see him or talk to him because he is just this way. Perhaps Kim has been in contempt all those times because she can’t bring herself to force her child to go off with him. Perhaps it devastates the child each time. Perhaps this is the case.

Perhaps the child has reached the age where she can no longer stay silent and doesn’t feel she should be forced to see someone she chooses not to. Perhaps because he’s a whack job, or because her Mom has manipulated her all along, or because she’s a spoiled brat, whatever the truth is. Maybe this is just the first shot across the bow by this child who’s fed up with the lot of them.
I think that’s an awfully lot of speculation.
I haven’t read anywhere besides the gossip sites that are speculating that Ireland sent in the tapes. Kim’s side didn’t say it and neither did Baldwins. It makes no sense to think that and I find it hard to believe that even TMZ would publish a tape sent to them by a kid without verifying the information or getting the OK to post the recording without parental approval.
What he said wasn’t nice but I hear parents calling their kids worse things or just as bad in the supermarket. I’ve heard “what are you, retarded?” or “how stupid can you get?” or parents cursing at their kids. Is the word pig (which I’d never use) worse than calling a kid a retard?
No apology necessary. I didn’t really mind, except that it seemed sort of out of left field. 
Well, who said that abusive parents are especially uncommon? All those things you’ve overheard would make me mentally question someone’s parenting skills.
Now I don’t have enough info to brand Balwin an abusive parent, but I can say that without a doubt the language he was using is abusive. I don’t care if the kid just burned down the house. Calling them a disgusting pig is indefensible. Like a few others in this thread, I’m scratching my head, wondering if people are reading the same transcript that I am.
My dad has a notorious temper that flares up out of nowhere sometimes, and when it happens he can say really mean things, but despite all of that, he has never resorted to the kind of insults that Baldwin did. He may have come close, but he never went there all the way. So it’s not like I’m stranger to angry reactions. People flip out, I understand that. But still…how can anyone not see his response as completely inappropriate?
The man lost his temper with his misbehaving child. This is an utterly unremarkable event. The “pig” part is probably unadvisable, but well within the bounds of ordinary human behaviour. The idea that this event might be considered child abuse and reported to the authorities is downright shocking, far more shocking than Baldwin’s wig-out.
Considering his overall look (especially his face and eyes), Alec Baldwin calling anyone a “pig” is like watermelon calling cherries “red.”
