Someone did a slamming good job at turning Mario 64 for the original Nintendo 64 into a almost completely different game, what if anything will Nintendo have against this? I understand that technically having roms and emulators are a gray area if not downright illegal and that decompiling software for reasons like this would also violate certain laws/agreements but come on… This is just awesome this is what they should have come up with but didnt’? How are they going to handle this?.
Are they (the emulator creators) trying to profit off of it?
Is Nintendo’s copyright on the characters names and likenesses still in effect?
If the answer is yes to both of these, then Nintendo will shut them down via legal means. If it is no to either of them, they’ll probably ignore it.
Time will tell. “Get your copy now, just in case!” - is probably an argument they’re using somewhere…
Romhacks of Nintendo games aren’t exactly new. Maybe they’d care if it was a hack of a recent game, but definitely not for Super Mario 64.
Legally, Nintendo *could *shut them down. They’re using copyrighted characters without authorization, which is a no-no even if you’re not charging for it.
However, most companies have realized that fan creations are actually good for the brand, so they turn a blind eye to stuff like this unless its somehow directly affecting their ability to make money. Nintendo probably won’t do anything.
