In today’s Wall Street Journal is a small article on NJ Assemblyman Anthony Impreveduto wanting NJ to sue the NFL.
To be fair, the columnist makes light of the suit, but what is wrong with people. Is anything that upsets anybody, is any human gaffe, now fair game for litigation?
Sorry for the lack of colorful language, but I’m not very inventive in its use. I put this in the pit hoping someone could bring a smile to my face with some humorous, original invective thrown at this illegitimate son of a rodent.
It’s not lawsuit abuse, it’s simple political blustering. This way Assemblyman Impreveduto gets to sound like he’s doing something, while taking no responsibility.
If the NJS&EA were to actually file the suit, it would likely be considered frivolous and dismissed. But to have a politico flap his jaws about who should be sued, is just noisemaking and political grandstanding.
But if NJS&EA were to follow up and actually file suit, even having it considered frivolous is going to cost the NFL big bucks.
Maybe I should run against Tony next election and say to the constituents, “Look what a bonehead this guy is.” And lose, because people would rather be stuck with the bonehead they know versus the bonehead they don’t know.
Wouldn’t have to be able to show the outcome of the game would have been different if not for the gaffe? Which he can’t do. I mean, the center blew 2 snaps in a row. What makes him think he wouldn’t have muffed the 3rd in row also?
Even though I’m sure no suit will be filed, it’s upsetting that an elected official could make such a dumb suggestion without being laughed out of office. Unfortunately, such a suit is not totally unthinkable.
This sort of nonsense was tried by a fan against a hockey player who refused to play during contract negotiations. The court tossed the case out rather than let it go to trial. Being a Canadian case, there were costs against the fan. Potechin v. Yashin, [2000] O.J. No. 1660, Court File No. 99-CV-11500-CP, (Ontario Superior Court of Justice, Charbonneau J. ).
