Yet another collossal government fuck up.

A New York Times report of a legal brief from a Georgetown University Law Professor points out that the majority of members of Board of Patent Appeals and Interferences are improperly empaneled.

The law was changed in 1999, and since that time the Justice Department, while simultaneously publishing doctrine about the constitutional importance of appointments, has failed to notice that this has happened. Their current official response is: Charles Miller, a spokesman for the Justice Department, said the government had no comment. “There is really nothing we can say at this time,” he said.
