Sorry, I had meant “legal argument”. There are laws against harassment by law officers, for political and corrupt purposes. If it can be proved that they were doing so, that would be a completely reasonable legal defense and the case should be summarily tossed.
The idea that the lawyers were arguing that Barrack missed his chance for a pardon is an insertion by the article author. I would recommend against reading the materials of an author who would do that, as it is subtly deceitful.

Unfortunately as I pointed out in a different thread, when it comes to the Presidential Records act, its up to the president himself to determine what constitutes a record that needs to be saved. 
My response would be to offer a wry smile and politely inform the defendant that he is certainly within his rights to request clemency from the current presidential office holder who I have no doubt will give it all of the consideration that it deserves.
