It depends on the state law. New York state has a law that recognises double jeopardy for federal offences, but they recently amended it to exclude anyone who got a federal pardon. New York DAs can charge someone under state law who has been pardoned federally.

In Manafort’s case, the courts ruled that double jeopardy did apply. But yes, in many cases it shouldn’t.

A lot of those loose ends could have been sorted out if only the Trump administration had actually worked with the Biden transition team.

I hope the notifications also included one or more quotations from Trump Administration officials (ideally the recipient him- or herself), along the lines of ‘we are pursuing these lawsuits to dismantle the ACA because we believe this is best for America’ or ‘we don’t want to reward lazy, irresponsible behavior, therefore we are cutting this benefits program.’

That would be sweet.

Smartmatic is jumping on the defamation train with a $2.7 billion lawsuit against Fox News, Sidney Powell, Guiliani, Lou Dobbs, and Jeanine Pirro.

Smartmatic is seeking damages of “no less than $2.7 billion,” the complaint says, and is requesting a jury trial. Its move against Fox follows two lawsuits filed last month by Dominion Voting Systems: one against Mr. Giuliani, the other against Ms. Powell. Dominion is another company named by conspiracy theorists claiming election fraud.

Say what you will about Donald Trump, but you have to admit: his ability to fuck over his friends and allies is god-level.

Kurt Eichenwald, today, has detailed a bit of the case against Fox News, with specific lies told by Fox anchors (sometimes repeatedly). He ends his thread with:

Where was Fox’ legal department while all this was happening? Do they never have someone with a law degree review their stories to pull them back in when they go a little too far out on a limb?

That’s OK, I think I know the answer to that one.

One of Fox’s problems seems to be that Fox News has essentially no management. Lachlan Murdoch basically does nothing, and Suzanne Scott just sits around and twiddles her thumbs. That has allowed their hosts to get progressively more insane with no supervision or direction. The clowns are running the circus over there.

Before he was fired for being a psycho creep, Roger Ailes would at least reign in the on-air cretins from time to time when lawyers started freaking out. Scott and Murdoch seem to have no particular involvement with actually managing their talent.
